Also this firmware update gives Nintendo the ability to remotely Brick your system if it detects you’ve been using a flash card or unaurthorized device. Nintendo, like most companies, takes a tough stance against piracy. I’d recommend that those lucky enough to own a 3DS stear clear of using flash cards altogether.
Flash cards aren’t illegal to use per se — homebrew? Some countries have banned them from import and sale, and they have been known to be used for illegal activity.
It is unclear though what bodily injuries could occur from homebrew software, given the nature of the device some sort of eye injury would be my guess. Perhaps Nintendo should also issue a statement on the dangers of playing your 3DS while crossing the street.
A little more information from Nintendo on specifics would help, however it is clear they are taking a stance on the issue and are concerned for our safety. Stay tuned any follow ups as more information becomes available.
